Information regarding the processing of personal data (Art. 13 Italian Legislative Decree 196/2003)
  1. The data subject or the person who collected the personal data are informed orally or in writing about:
    1. the objectives and modalities for the processing of the data;
    2. the mandatory or optional nature of required data;
    3. the consequences of any refusal to answer;
    4. those persons or classes of persons to whom the personal data may be communicated or who can be aware of such data as managers or agents, and the scope of dissemination of these data;
    5. the rights under Article 7;
    6. the identity of the owner and, if appointed, the representative in the State under art. 5, and of the person in charge. When the owner has designated more than one person in charge, at least one of them must be indicated, as well as the site of the communication network or a way to easily access the updated list of persons in charge. When a person in charge has been designated to respond in case the data subject wishes to exercise his right as per art. 7, he/she has to be indicated.
  2. The information referred to in par. 1 also includes those elements provided for by specific provisions of this Code and may not include elements already known to the person providing the data or whose knowledge may concretely hinder the performance of an inspection or checking activity by a public official for purposes of defense or state security or the prevention, detection or repression of crime.
  3. The Authority may issue a provision to simplify the procedures for the information given in particular by telephone services providing assistance and information to the public.
  4. In case personal data are not obtained from the data subject, the information referred to in paragraph 1, including the categories of processed data, is given to the data subject when the data are registered the data or when their communication is envisaged, in any case not after the first communication.
  5. The provision in Paragraph 4 shall not apply if:
    1. the data are processed in accordance with laws, regulations or the European legislation;
    2. The data are collected for the purpose of carrying out defense investigations referred to the Law of 7 December 2000, n. 397, or in any case to enforce or defend a law in court, so the provided data must be processed exclusively for such purposes and for the period necessary to achieve the same;
    3. Information to the data subject implies the use of means which the Authority, prescribing any appropriate measures, declares to be clearly disproportionate compared to the protected right or if it appears to be impossible at the sole discretion of the Authority.
    Art. 7 Right to access personal data and other rights
    1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him/her exist regardless of their being already recorded, and communication of such data in intelligible form.
    2. A data subject shall have the right to be informed:
      1. of the source of the personal data;
      2. of the purposes and methods of the processing;
      3. of the logic applied to the processing, if the latter is carried out with the help of electronic means;
      4. of the identification data concerning data controller, data processors and the representative designated as per art. 5(2);
      5. of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representatives in the state’s territory, data processors or persons in charge of the processing.
    3. A data subject shall have the right to obtain:
      1. updating, rectification or, where interested therein, integration of the data;
      2. erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
      3. certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
    4. A data subject shall have the right to object, in whole or in part:
      1. on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
      2. to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or for the performance of market or commercial communication surveys.
